HyraXP by JamesValé Recruitment (“HyraXP”) is an Australian owned and registered company engaged in providing permanent staffing and recruitment solutions to employers nationwide. By requesting an invoice, making payment, providing either verbal or written approval to proceed, providing HyraXP with vacancy information or by viewing a resume that has been presented by HyraXP, the Client agrees to these Terms. The following Terms of Service apply to the entire agreement and no variation or alteration to these Terms will be valid by the Client. HyraXP reserves the right to change or amend the Terms of Business at any time necessary.

Authority to Act

Once a candidate has been submitted to your company, that candidate has provided authorisation to HyraXP to act as an agent on their behalf and present their details to you. HyraXP has been authorised by the candidate to submit all relevant documentation and their details and makes no representations as to the accuracy of the information contained herein or in the submission of the candidate’s profile or resume. HyraXP, its associates and/ or agents shall not be liable for any loss, damage, costs, claims, liability, or expenses suffered or incurred arising from or connected with, the recruitment or employment of any candidate referred by HyraXP. The decision to offer and hire a candidate is solely that of the Client.

Using our Service

If you contact us, book an online consultation, or send vacancy information, we will contact you to discuss HyraXP services in more detail. Once we have received payment via credit card or by the transfer of funds, we will commence the purchased consultation, service, or package.

Online Consultation

Online Consultations are charged at a rate according to the consultation time and volume of Candidates resumes the Client elects to purchase. The Online Consultation involves both the Client and Recruiter meeting via an online video link or phone call. The initial stage of the consultation will be a brief introduction to discuss the specifics of your vacancy, performing key searches and screen-sharing suitable candidates’ profiles from the HyraXP database. Candidates resumes are then selected by the Client from a list provided; following the end of the meeting, the Recruiter will then send the Client the agreed upon candidates resumes, along with any additional candidates resume agreed upon during the meeting. Any additional Candidates resumes can be purchased by the Client for the scheduled cost either during the consultation or following. All fees that are quoted and listed on the HyraXP website are exclusive of GST.

 

Payment

Payment for all services is upfront and accepted via Credit Card or Electronic Funds Transfer. HyraXP will not commence any service until payment is made in full.

Guarantees*

HyraXP will offer a Client the following guarantees upon purchasing an online consultation:

Ten Experienced Candidate Guarantee:  

• If the Client is unable to make contact with at least two candidates, due to their details being incorrect or there is no response from the candidates within 7 days of purchase, HyraXP will provide up to 2 additional candidates to be selected by the Client at no additional charge. In order to redeem the guarantee, the Client will need to provide information of the candidates whose details are either incorrect or who are not responding to both phone calls or emails. In the event of a candidate not willing or prepared to consider the opportunity put forward by the Client, then the Client is not eligible to claim the guarantee.

Fifteen Experienced Candidate Guarantee:  

• If the Client is unable to make contact with at least four candidates, due to their details being incorrect or there is no response from the candidates within 7 days of purchase, HyraXP will provide up to 4 additional candidates to be selected by the Client at no additional charge. In order to redeem the guarantee, the Client will need to provide information of the candidates whose details are either incorrect or who are not responding to both phone calls or emails. In the event of a candidate not willing or prepared to consider the opportunity put forward by the Client, then the Client is not eligible to claim the guarantee.

Delivery

Delivery of Candidates resumes will be made within 2 business days following an online consultation. HyraXP will use best endeavours to deliver experienced (XP) candidate packages within 2 business days of payment.

 

Service Fees**

The fees for HyraXP services are to be made on an upfront payment basis. All fees that are quoted on our website are exclusive of GST.

1. HyraXP is not responsible for the selection of any candidate by the Client; HyraXP is not responsible for any acts, errors or omissions, wilful negligence or otherwise committed, by submitted or successful candidates.

2. Unlimited hires may be made under the same consultation or service.

*The guarantee applies to each online consultation package and is only exempt in circumstances where the total available candidate pool is small i.e. below 40.

Job Offer and Acceptance

After written acceptance by the candidate, a formal letter and employment contract of offer should be produced by your company as per Fair Work Australia guidelines.
